Temporary Resident
Permit Holders

If you are a temporary resident permit holder and you meet a number of requirements as set by the government of Canada, you may be eligible to apply for permanent residence.

In order to meet the requirements of this class, you must meet a residency requirement as well as pass various inadmissibility circumstances. 

If you have been a resident of Canada for a minimum of 3 years and you meet the following criteria:

  • your are inadmissible on health grounds under subsection A38(1); or

  • you are inadmissible for having come to Canada as an accompanying family member of a foreign national who is inadmissible on health grounds; or

  • you are inadmissible on grounds for having come to Canada as an accompanying family member of a person described above

If you have been a resident of Canada for a minimum of 5 years and you meet the following criteria:

  • if you are inadmissible on any grounds not mentioned above with the exception of the following:

    • security​

    • violation of human or international rights

    • serious criminality

    • organized crime

If you meet the above-noted residency requirements as a temporary resident permit holder and the following other requirements of this class, you are eligible to apply for permanent residence:

  • you have not become inadmissible on any grounds other than those for which your original TRP was issued

  • you currently hold a valid TRP

You are not eligible for this program if there has been a break in continuity of your residence in Canada. If you have left Canada without being authorized to re-enter the country, or you did not apply for a new TRP prior to the expiration of your existing TRP, this means you do not meet the requirement of continuous residence, which will negatively affect your eligibility for permanent residence in this class. While there is some discretion in an officer's assessment of this requirement, they will review your reasons for absence from Canada depending on what the circumstances were.

What will be assessed

An officer will assess various things when reviewing an application for permanent residence under this class, some of which include:

  • the reasons for why your initial TRP was issued to you

  • why any subsequent TRPs were issued to you (if any)

  • other information in your application, such as medical documents, best interest of a child, etc.

Accompanying family members

If you had an accompanying family member with you at the time you initially entered Canada with a valid TRP, those family members will have to submit their own application for permanent residence if they are TRP holders and meet the requirements for permanent residence under this class. If you have family members overseas and you are eligible to apply for permanent residence as a temporary resident permit holder, you will be able to apply to sponsor them once you become a permanent resident, if they are eligible under the family class.
